Eventbrite Contest Rules

Eventbrite and Rally (collectively “Eventbrite”) run various contests through their websites and mobile applications. All contests are based upon skill. These various Instagram Contests are referred to collectively herein as “Instagram Contests.” (All sweepstakes are based primarily on chance and will follow a different set of rules and these rules do not apply). Other contests will have their own separate terms and conditions. These terms apply only to Contests administered through Instagram. Terms for Instagram Contests.

Instagram Contestant’s participation in any Instagram Contest is subject to and governed by the official rules set forth here, along with any additional guidelines (“Additional Terms”) outlined in the Specific Instagram Contest listed on eventbrite.com, or on the Instagram page where the Contest call to action is located. For every Instagram Contest, there will be additional terms, including the end date of the promotion, the prize and prize value, and in some cases, changes to the eligibility requirements for the specific Instagram contest (the “Specific Instagram Contest”). If there is a conflict between these official rules and the Additional Terms outlined in the Specific Instagram Contest, the Additional Terms will govern.

1.1 Eligibility.

Unless otherwise noted in the Additional Terms outlined in the Specific Instagram Contest, Eventbrite Instagram Contests are open to legal residents of the 50 United States and Canada (excluding the Province of Quebec) who are the age of majority in their jurisdiction (“Instagram Contestants”). Instagram Contest supervisors and members of their immediate families are not eligible to participate or win. Instagram Contests are subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited. Please note that Eligibility may be limited to a specific geographic area. Always check the Additional Terms for the Specific Instagram Contest.

1.2 Instagram Social Media Disclosure.

All Instagram Contests follow the guidelines of Instagram. Instagram Contests are in no way sponsored, endorsed or administered by, or associated with Instagram. Instagram Contestants are providing their information to Eventbrite—and not to Instagram—during the entry process. The information Instagram Contestants provide will be used for administering the Specific Instagram Contest and/or for marketing purposes in accordance with these Terms of Use and with Eventbrite’s Privacy Policy.

1.3 Our Instagram Contests.

Instagram Contestants should review the Additional Terms for information regarding whether purchase is necessary for a Specific Instagram Contest.

1.4 Sponsor.

Unless otherwise outlined in the Additional Terms for the Specific Instagram Contest, the Sponsor of the Instagram Contest is Eventbrite, Inc., 95 Third Street, 2nd Floor, San Francisco, California, 94103 (“Sponsor” or “Eventbrite”).

1.5 Instagram Contest Period.

The Instagram Contest begins and ends on the time and date outlined in the Additional Terms outlined in the Specific Instagram Contest, according to Sponsor’s internal time clock and time zone. All times for the events are listed in the local time where the event is located, whether Pacific Daylight Time (PDT), Pacific Standard Time (PST), Eastern Daylight Time (EDT), or Eastern Standard Time (EST).

1.6 Only one entry per natural person per Instagram Contest.

Unless otherwise noted in the Additional Terms outlined in the Specific Instagram Contest, or otherwise herein, Instagram Contestant may only enter one time. Multiple entries for Instagram Contests will not increase Instagram Contestant’s chances of winning (Instagram Contestant will still only receive one entry). If Instagram Contestant enters more than once in a Instagram Contest, only Instagram Contestant’s last eligible entry will be counted and scored.

Instagram Contestant may enter as many current Instagram Contests as Instagram Contestant is otherwise qualified to enter. In any given year, if Instagram Contestant’s winnings exceed US$600, those winnings may be considered a taxable event by the IRS and Eventbrite may be required to issue the Instagram Contestant a tax form 1099.

How to Enter.

Instagram Contestant must have a non-private Instagram account. Instagram is free to join and Eventbrite makes commercially reasonable efforts to make sure Instagram Contests follow the guidelines set forth by Instagram.Hashtags may be listed in the Additional Terms as a requirement. In all cases where an Instagram Contestant is required to place hashtags on the entry, all hashtags must be included or Instagram Contestant’s entry will not be eligible for the Specific Instagram Contest and will not be judged.

2.1 Entry.

Online Entry Only. To participate, Instagram Contestants must have or create a non-private Instagram account (“Instagram account”). If Instagram Contestants already have an Instagram account, Instagram Contestants must sign in to their account. If Instagram Contestants are not existing members of Instagram, Instagram Contestants are required to follow the directions and join Instagram. When Instagram Contestants join Instagram, Instagram Contestants agree to the Instagram Terms of Service and Privacy Policy. Membership to Instagram.com is free.

Using Instagram, during the Instagram Contest Period and for all contests, Instagram Contestants must follow the Eventbrite Instagram account listed in the Additional Terms outlined in the Specific Instagram Contest.

All Instagram Contests require the Contestant to upload an image for judging, use the required hashtags, and in some cases tag a friend (see Additional Terms outlined in the Specific Instagram Contest for more details).

Submissions.

3.1 Submission Details.

Submission details will be outlined in the Additional Terms for the Specific Instagram Contest (“Submission”). The Submissions must be original and created by the person who posted it, and must include any other elements listed in the Additional Terms for the Specific Instagram Contest. The Submissions cannot have been submitted previously in any prior Sponsor contest or promotion.

3.2 Submission Guidelines.

There are some limits to what Instagram Contestants can do:

  • Submissions must be original works of authorship, created by the person who enters the Submission. Instagram Contestants may not copy or otherwise plagiarize the Submission from any source, nor may the photo include third-party copyrighted material or artwork, without the copyright holder’s permission. By entering, Instagram Contestants warrant that the Submission does not infringe any third party’s rights, and that Instagram Contestants have obtained any necessary permissions from all relevant third parties to submit the Submission. Any images used in the Submission must be an original work of authorship under U.S. Copyright Law.

  • Instagram Contestants may not be, nor may they use in the Submission parties who: 1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to show the Submission in any media form; 2) have an acting or modeling contract that would make Instagram Contestants’/their appearance in the Submission a violation of any third party rights; 3) are under a merchandising agreement; or 4) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this promotion, or from allowing Sponsor to use the Submission online and in television and any and all media.

  • Submissions must not violate the rights of any third parties, including intellectual property rights, rights of privacy, or any other rights held by third parties.

  • Instagram Contestants hereby agree to indemnify Sponsor against any and all claims from any third party for any use by Sponsor of the Submission.

  • Although Sponsor is not reviewing Submissions for copyright or trademark violations, if, in the sole discretion of Sponsor, it is believed the Submission constitutes or may constitute copyright or trademark infringement, the Submission will be disqualified.

  • Sponsor reserves the right to exclude any Submission that it believes, in its sole discretion, doesn't meet the criteria set forth in these guidelines, and to delete any such Submission from any and all location(s) under Sponsor’s control.

  • No Submission shall portray Sponsor or any third party in a negative light.

  • Please, do not use the Submission to launch personal attacks on anyone or any discernible product, including competitor products.

  • Submission may not depict nudity, animal cruelty, or illegal activity or substance, or offensive or obscene subject matter as determined in Sponsor’s sole discretion.

Judging.

4.1 Judging Details.

All otherwise qualified Submission will be judged. Unless otherwise noted in the Additional Terms, Judging will be based upon the following criteria and on a one-hundred (100)-point scale:

  1. Creativity and Originality: 50 points

  2. Relation to Theme: 30 points

  3. Image Quality: 20 points

All Submissions will be screened to insure the Submissions have correctly met the Submission guidelines and meet with Sponsor’s general standards and practices prior to any judging (“Qualified Submissions”). In the event of a tie, the entry with the highest “Creativity and Originality” score will be deemed the Winner.

4.2 Disqualification.

Any Submission that is considered by Sponsor in its sole discretion to be obscene, libelous, inapposite to the reputation of Sponsor, or otherwise objectionable or inappropriate, or which otherwise does not comply with these Official Rules will be disqualified. Except as otherwise stated in these Official Rules, personal information collected in connection with this Instagram Contest will be used in accordance with Sponsor’s privacy policy and with the consent given by Instagram Contestant at the time of entering a Submission. Proof of submitting any Submission is not considered proof of delivery to or receipt of such Submission. Furthermore, Sponsor shall have no liability for any Submission that is lost, intercepted or not received by the Sponsor.

Winning, prices, and publicity.

5.1 Instagram Contest Winner Selection.

In accordance with the Additional Terms listed in the Specific Instagram Contest, on or within forty-eight (48) hours of the end of the Instagram Contest Period, and unless otherwise outlined in the Additional Terms for the Specific Instagram Contest, one (1) Instagram Contestant with the highest score will be selected by Sponsor or its representative from among all eligible entries received (the “Selected Instagram Contestant”).

5.2 Instagram Contest Winner Notification and Announcement.

Unless otherwise noted, Selected Instagram Contestants will be contacted by way of direct message via Instagram and will be given instructions on how to claim their prizes. Only one attempt to contact the Selected Instagram Contestant will be made. The Selected Instagram Contestant will be required to respond (as directed in the direct message) within seven (7) calendar days of attempted notification. In some cases, due to the nature of the prize, the turnaround time may be as little as 24 hours. In such a case, the Additional Terms will so indicate. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case Sponsor may—but is not obligated to—select an alternate Selected Instagram Contestant.

5.3 Prize.

Unless otherwise outlined in the Additional Terms for the Specific Instagram Contest, the prize will consist of event tickets that will be available for pickup at Will Call at the event or will be mailed to the winner, and/or digitized event tickets delivered to the Selected Instagram Contestant via email or direct message on Instagram. The prize, the number of prizes, and the individual and total retail values of those prizes are listed in the Additional Terms outlined in the Specific Instagram Contest. The prize is limited to what is outlined in the Specific Instagram Contest. Anything not listed is not included and should not be implied. For instance, if the prize includes event tickets, transportation to and from the event and other fees are not included.

Event tickets may have specific terms and conditions. Winners are responsible for reading and understanding all limitations on the event tickets, whether printed on the tickets or provided to the winner in electronic form, including whether or not guests under the age of 18 are allowed into the venue. In some cases, winners may be required to show additional identification at the entry to the event.

5.4 Publicity.

By participating in the Instagram Contest, any Instagram Contestant irrevocably grants the Sponsor and their respective successors, assigns, and licensees, the right to use such Instagram Contestant’s entry or submission, name, likeness, biographical information in any and all media for any purpose, including without limitation, commercial, advertising and promotional purposes as well as in, on, or in connection with the Instagram Contest or other promotions, and hereby releases the Sponsor from any liability with respect thereto, unless prohibited by law.

5.5 Prize Conditions.

In cases where the prize in a Specific Instagram Contest exceeds US$600, the Selected Instagram Contestant may also be required to complete additional paperwork, and may be required to provide Sponsor with their social security number and may be issued a tax form. In the event of a dispute about the identity of an Instagram Contestant, each entry will be declared made by the name and relevant information submitted at time of entry. Sponsor will not make multiple attempts to contact Selected Instagram Contestant.

No substitution, transfer, or cash redemption of prize permitted, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Unless otherwise outlined in the Additional Terms for the Specific Instagram Contest, no travel or transportation to or from the event location is included in the prize. Selected Instagram Contestants are responsible for all travel arrangements necessary.

Conditions of Participating.

By participating, Instagram Contestants agree to be fully and unconditionally bound by these terms, the Additional Terms for the Specific Instagram Contest, and the decisions of Sponsor, and waive any right to claim ambiguity in the Instagram Contest. Any portion of the Instagram Contest may be canceled, suspended, and/or modified, in whole or in part, if in Sponsor’s opinion any fraud, technical failure, or other factor beyond Sponsor’s control impairs the integrity or proper functioning of the Instagram Contest. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of any Instagram Contest or Sponsor’s website, to be acting in violation of these terms, or to be acting in an unsportsperson-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Instagram Contest, or to annoy, abuse, threaten, or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Instagram Contestants may not enter with multiple identities or use any automated system, bot, or other device or artifice to enter or obtain more than the maximum number of qualified entries. Sponsor reserves the right at its sole discretion to terminate any Instagram Contest and, if terminated, at its discretion, select the winner(s) by applying the judging criteria prior to action taken.

Limitation of Liability.

If for any reason an entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, the Instagram Contestant's sole remedy is another entry in the same Instagram Contest during the Instagram Contest Period listed in the Additional Terms outlined in the Specific Instagram Contest. Instagram Contestants also agree to release, discharge, indemnify, and hold harmless Sponsor and each of its respective officers, directors, employees, representatives, and agents (collectively “Releasees”) from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: (i) use, redemption, acceptance, possession, ownership, or misuse of any prize, (ii) participation in any activity, event, or excursion offered in connection with the prize, (iii) use of any facility, service, and/or accommodation related to the prize, or (iv) participation in any Instagram Contest-related activity or participation in any Eventbrite Instagram Contest. The Releasees shall not be liable for: (i) late, lost, delayed, misdirected, incomplete unreadable, inaccurate, garbled, or unintelligible entries, communications, or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical malfunctions, lost connections, disconnections, delays, or transmission errors; (iii) data corruption, theft, destruction, or unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, or damages of any kind caused by the prize or resulting from acceptance, possession, or use of a prize, or from participation in the Instagram Contest; or (v) any printing, typographical, administrative, or technological errors in any materials associated with the Instagram Contest. Without limiting the generality of the foregoing, Releasees are not responsible for computer malfunctions, network connections, email delivery problems, systems failure or incompatibility, typographical, technical or key-stroke errors, or interruptions in internet service, and for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen notifications. In the event Sponsor is prevented from continuing with a Instagram Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, or any federal, state or local government law, order, or regulation, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Instagram Contest. If the Instagram Contest is terminated before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

Privacy.

All personal information collected by Sponsor will be used for administration of the Instagram Contest. In addition, Instagram Contestants will receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Instagram Contestants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to privacy@eventbrite.com. Please refer to Sponsor’s Privacy Policy for important information regarding the collection, use and disclosure of personal information by Sponsor.

Disputes and Jurisdiction.

Disputes regarding these terms will be governed by the internal laws of the State of California. Decisions of Sponsor are binding and final. No claimant in any dispute involving Sponsor shall be entitled to claim or obtain indirect, punitive, incidental or consequential damages. Sponsor’s failure to enforce any provision in these Official Rules shall not constitute a waiver of that provision.

Winner’s List and Instagram Contest Rules.

To obtain a copy of Instagram Contest Official Rules or a winner’s list after the end of the Instagram Contest Period, email social@eventbrite.com. Please specify the date on which the Instagram Contest began, and the name of the specific Instagram Contest.
